Resumo
A justiça transicional é o complexo de práticas e processos supostamente destinados a ajudar as sociedades a passar da atrocidade para um futuro melhor, pós-atrocidade. Há quem a defina de forma mais sutil como a transição de um regime político para o próximo. As práticas e processos de justiça transitória abraçaram, em diferentes graus, a forma da lei. O direito neste contexto tem sido tanto generativo quanto gerado em foros de reforma constitucional, de exigir e receber contas dos perpetradores de atrocidades, de dar às vítimas a oportunidade de nomear e recontar suas tragédias pessoais e receber reparação, de punição retributiva, consequencialista e simbólica, de estabelecimento de um registro verdadeiro do passado e de (re)conciliação.
